1. The agreement

These terms are an agreement between Articsoft (“SkyPos”, “we”, “us”) and the business that signs up for SkyPos (“the shop”, “you”). By creating an account or using the service you accept these terms on behalf of the shop and confirm you are authorised to do so.

Our Privacy Policy explains how we handle personal information and forms part of these terms.

2. The service

SkyPos provides cloud software for running a shop: point of sale, repairs, stock, customers, documents, reporting and related tools, available in the browser and in the desktop app. Features vary by plan and may be added, changed or retired over time. We will give reasonable notice before removing a feature you pay for.

3. Accounts and staff

  • You must give accurate information when signing up and keep it up to date.
  • You are responsible for the staff you invite, the roles and permissions you give them, and everything done under your account.
  • Keep passwords, PINs and devices secure, and tell us promptly at hello@articsoft.co.za if you suspect unauthorised access.

4. Plans, trials and payment

Paid plans are billed in advance at the prices shown on our pricing section or in the app at the time of purchase. Payments are processed by our payment provider. A free trial, where offered, ends on the date shown in the app; continuing after that requires a paid plan.

You can cancel at any time in the app. Cancellation takes effect at the end of the current billing period and fees already paid are not refunded, except where the Consumer Protection Act or other law requires. If payment fails we may limit the account until it is settled. We will give at least 30 days’ notice of price changes.

5. Your data

The shop owns the business data it enters into SkyPos. You give us permission to host, process and back it up only as needed to provide the service. You are responsible for having a lawful basis, under POPIA, for the customer information you record and for the messages you send to your customers.

You can export your data from the app. After an account is closed we keep data for a limited period so it can be restored if closed by mistake, then delete it, except where the law requires us to keep it.

6. Acceptable use

You must not use SkyPos to:

  • send spam or unsolicited bulk messages, or messages that break the Electronic Communications and Transactions Act or POPIA’s direct-marketing rules;
  • sell stolen, blacklisted or illegal goods, or record false transactions;
  • break any law, or infringe anyone’s rights;
  • try to access other shops’ data, probe or disrupt the service, or get around its limits or security;
  • copy, resell or reverse-engineer the software, except as the law allows.

We may suspend accounts that break these rules, and will tell you why unless the law or a security risk prevents it.

7. Connected services

You can connect third-party services such as Gmail, Google Drive, Yoco, Telegram and WhatsApp. When you do, you allow SkyPos to act on that service on your behalf, only for the feature you turned on (for example, sending receipts from your Gmail address). Those services have their own terms, and you are responsible for following them.

You can disconnect a service at any time in Settings. We are not responsible for outages or changes made by third-party services.

8. AI features

Some features use AI to suggest prices, extract product details, answer questions or create images. AI output can be wrong; check it before relying on it, especially for prices, tax and customer communication.

9. Availability and support

We work to keep SkyPos available and to fix problems quickly, but the service may sometimes be interrupted for maintenance, outages at our providers, or events outside our control. Support is available by email at hello@articsoft.co.za.

10. Warranties and liability

SkyPos is provided “as is”. To the extent the law allows, we do not guarantee it will be error-free or meet every need, and you remain responsible for your own accounting, tax returns and legal compliance.

To the extent the law allows, we are not liable for indirect or consequential loss such as lost profits or lost data, and our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act that cannot be limited, or liability for fraud or gross negligence.

11. Ending the agreement

You may close your account at any time. We may end or suspend the service if you seriously or repeatedly breach these terms, or do not pay, after giving notice where reasonable. Sections that by their nature should survive - such as liability, payment owed and data deletion - continue after the agreement ends.

12. Changes to these terms

We may update these terms. We will tell shops about material changes at least 30 days before they take effect. Continuing to use SkyPos after that means you accept the new terms.

13. Governing law

These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction.
